GRIEVANCE REDRESSAL POLICY (“Policy”)

Indus Appstore is owned and operated by Indus Appstore Private Limited (“Indus”/ “We”), a company incorporated under the Companies Act, 2013, having its registered office at Office-2, Floor 4, Wing B, Block A, Salarpuria Softzone, Service Road, Green Glen Layout, Bellandur, Bangalore, Karnataka, India - 560103.

We value the trust placed upon us and strive to offer the best experience to all our Developers and Users. Our endeavour is to provide our Developers and Users with a seamless experience while using the Indus Appstore and accordingly, the below mechanism has been designed to address any grievance that any person (individual or entity) may have regarding any application, other digital content or services available through the Indus Appstore (hereinafter referred to as “Content”) in a timely and efficient manner.

DEFINTIONS:

“Developer” shall mean any person (individual or entity) whose software, content and/or android based mobile application (including its .apk/.aab/.obb file) is published and accordingly, distributed on the Indus Appstore.

“User” shall mean an individual who is the user of the Indus Appstore via any android based device including, but not limited to, a mobile phone, tablet or any other device (as may be enabled by Indus from time to time).

Who can raise a Grievance?

Any Developer, User or any other person (individual or entity) whose rights have been infringed/violated by the Content can raise a grievance.

What grievances can you raise? You can raise grievances with us regarding any Content being in violation of the Indus Developer Policies and/or Indus Appstore Developer Terms and Conditions and/or the applicable law (hereinafter referred to as a “Grievance/s”). Grievances can be reported to us under the following categories:

  1. Misappropriation/Misrepresentation: The Content belongs to another person and to which the Developer/User (as the case may be) does not have any right;
  2. Harmful to children: The Content is harmful to children;
  3. Intellectual property infringement: The Content infringes any patent, trademark, copyright or other proprietary rights;
  4. Misleading or Deceptive: The Content deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
  5. Impersonation: The Content impersonates another person;
  6. Sexually inappropriate content: The Content is obscene, pornographic, paedophilic, invasive of another person’s privacy, including bodily privacy;
  7. Sensitive content: The Content is insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable;
  8. Any other Grievance. When a Grievance is received by us, We will conduct an investigation and inform you of the action (if any) taken within a reasonable period of time and shall endeavour to do so within fifteen (15) working days of the Grievance being raised. How do I report a Grievance? You can report a Grievance by sending an email to [email protected]. When raising a Grievance, We request that you state the relevant category of Grievance from the list provided above and provide a brief description of the Grievance along with supporting documents, if any, to enable us to investigate and take appropriate action. Please ensure that any information provided by you in relation to the Grievance is true and accurate. In the event the Grievance relates to (S.no 3) Intellectual property infringement or (S.no. 6) sexually inappropriate content, We request you to also provide details in the format as provided under Annexure I (Intellectual Property Complaint Form) and Annexure II (Sexually Inappropriate Content Complaint Form) respectively. What actions do We take for Grievances? Depending on the type and severity of the Grievance that is reported, We reserve the right to take one or more of the following actions: a. Block access to the Content from the Indus Appstore while We look into the Grievance; b. Notify the Developer and/or User, as the case may be, to rectify the Grievance within a fixed period of time. If the Developer and/or the User, as the case may be, fails to rectify the Grievance in the specified time period, access to the Content on the Indus Appstore may be blocked; and/or c. Remove the Content from the Indus Appstore. Depending on the nature of the Grievance, We may also report the Grievance to the appropriate authorities, at our discretion, or if required to do so by applicable law. Can We take an action without you raising a Grievance? If We identify any violation of the Indus Developer Policies and/or Indus Appstore Developer Terms and Conditions and/or the applicable law during our internal monitoring process, We may take the actions as detailed for a Grievance without the same being raised. What happens if We receive an order of a court or government agency in relation to some Content? If We receive a notice/order of a court or relevant law enforcement agency/authority in accordance with applicable law to take down certain Content or if such notice/order is brought to our attention by a Developer, User or any other person (individual or entity), We shall remove the Content from the Indus Appstore provided that the such notice/order identifies the infringing material clearly and specifically. We may take such action without prior notice to the relevant Developer and/or User, as the case may be, depending on the instructions provided to us in the notice/order from the relevant agency/authority. To have the Content reinstated to the Indus Appstore, We would require an order from the court or the relevant agency/authority that either: a. sets aside the takedown notice/order; or b. holds that the violation in relation to Content that was the subject-matter of the takedown notice/order has been corrected and the Content can now be reinstated. Please note that We do not mediate intellectual property disputes. Accordingly, contacting the Developer would provide a speedier resolution to such disputes. Some Developers list methods of contacting them within their application.

In the event you are unable to reach a resolution with the Developer in question, you may report a Grievance to our support team in the format as provided below (Intellectual Property Complaint Form). Post reporting of the Grievance, We will conduct an investigation and take such action as is specified in this Policy. In the event you have a court order granting an injunction against the use of the intellectual property, a copy of the order should be submitted to us while reporting your Grievance for necessary actions.

Please ensure that the Grievance raised by you contains requisite supporting documents including, but not limited to, images/documents from the trademark/copyright office as proof of your ownership of the mark in question, your registration number and the infringement details and copy of a court order / if any. By sending details as per the below format via the email address specified above, You affirm that: ● You are the owner of the intellectual property or authorised to act on behalf of the intellectual property owner; and ● You have good faith belief that use of the intellectual property described above is not authorised by the intellectual property owner or its agent, nor is such use otherwise permissible under applicable law.
